New York Free Divorce Records

By Ben Kingsley

Like any other vital records, certificates or decrees of divorce are legal documents. Such documents can be beneficial in various ways. You may need a legal copy of your divorce file should you wish to be remarried. It is always a brilliant idea to do a self background check to review the accuracy and completeness of the record. A record of divorce in New York can be obtained from the Vital Records Office in the Department of Health.

There are two types of divorce records in New York: decrees and certificates. A divorce decree indicates the conditions and terms of the separation and is filed in the county where the divorce was approved. Prior to 1963, records of divorce that were available then were decrees. Divorce certificates, on the other hand, are confidential by law and are restricted to the persons named on the document and those authorized by them only.

Each copy of a divorce record in New York, either certificate or decree, is worth $15. Payment should be through check or money order made payable to the New York State Department of Health. Such fee is non-refundable regardless if the divorce record requested is found or not. In case the divorce record is not located, the office will issue a "Certificate of Failure to Find".
